This document hereinafter referred to as “Terms and Conditions” is a digitally signed, distance contract and sets out the terms and conditions of the products sold via the online shop. By accepting the Terms and Conditions, you also agree with the Return Policy, the Privacy Policy and all the other information mentioned in this document as well as in our other policy documentation available on our site.

jellí reserves the right to modify the Terms and Conditions at any time. Any changes to the Terms and Conditions shall enter into force only for new orders registered after the publication of those amendments on this website. We would therefore ask you to read the Terms and Conditions before each order, in case that changes may have been made since your last visit.

  1. GENERAL CONSIDERATIONS

jellí works to maintain the accuracy of the information found on our online shop. However, in view of possible errors in this information, we would point out that:

  • the brand and shape of the products may be perceived differently in the images available on the webpage compared to reality, but jellí provides full information on the characteristics of the products in the descriptions presented for each product, including their quantity.
  • the colours of the products, as shown on the webpage, may differ in reality because they depend on several factors, including, but not limited to, the calibration of your phone monitor or display and printing resources of our partners/collaborators.
  • the photographs and images on the webpage are only illustrative/indicative. For a precise description of the product and the details included, the corresponding description of the product must be given careful consideration.
  • the products will be delivered only to the extent that they are available, thus there is a risk that jellí may not be able to deliver a full or partial order. jellí also reserves the right to withdraw any product from sale at any time, without prior notice.
  • jellí shall make every effort to deliver the goods requested by the buyer in accordance with the delivery date assumed, as indicated in the e-mail with details of the delivery. Please note that all the information provided on delivery by website, telephone or e-mail is only estimated, based on the estimates of the partner courier companies and may therefore vary from case to case.
  • jellí reserves the right to adjust freely and in compliance with the legal provisions, prices and special offers applied, whilst still disclosing the EEA price indicators as mentioned by law.

Communication with the staff of jellí can be done by means of direct telephone interaction with the person concerned or by means of the addresses mentioned at the contact section of the Site.

The use of this website shall not be permitted for the purpose of deliberately introducing viruses or any other programme or material which may be technically harmful or destructive. Unauthorised access to this website, to the server on which it is hosted or to any other server, computer or database related to this website shall be prohibited. By accepting the Terms and Conditions, you will undertake not to attack this website by means of an attack to block the service or to block the service distributed.

Failure to comply with the provisions of this clause shall be reported to the competent authorities with a view to enforcing legal sanctions and shall result in the immediate suspension of the right to use this website.

Although we are making every effort to ensure safe navigation on its website, we cannot guarantee that the site, the servers on which it is hosted or e-mails sent do not contain errors, omissions, defects, delays or disruptions in operation or transmission, viruses or other potentially harmful computer components, line fits or any other similar factors. Please note that you use the site at your own risk, since jellí is not in any way liable for any direct or indirect damage caused by using or accessing/visiting the site or as a result of using the information on the site. Thus, it is in your advantage to ensure that adequate defence systems are installed in order to protect the virus device and/or any other harmful continuum.

jellí shall have the right, at any time, to modify, suspend or cease the online marketing of products, partially or totally, temporarily or permanently, with or without prior notification to any of its stakeholders.

  1. PLACING ORDERS

Access to the site for the purpose of placing an order shall be open to any client. For justified reasons, jellí is reserving the right to restrict access to those customers where it is considered that on the basis of its conduct or activity on the website, its actions could in any way disturb or prejudice the activity of jellí or other customers, informing it in advance of the reasons for the restriction.

By placing an order on www.jelli.eu, the customer agrees to be contacted (by telephone, SMS email, social media channels etc.) by representatives of our online shop. When placing the order, the customer agrees with the terms and conditions laid down in this section.

The confirmation of the order by our company is deemed to have been completed when there is an electronic confirmation (e-mail or SMS) from our company to the customer, without requiring an acknowledgement of receipt from the client. We do not consider at any time an order that has not been confirmed as having the value of a contract (also referred to as draft orders). Therefore, the contract enters into force upon confirmation of the order by the company.

If the customer, being a legal and authorised representative, wishes to receive a tax invoice for a commercial company, the company’s details will be filled in under the heading ‘Note’ when placing the order. It is not sufficient to specify the name of the company at the time of registration of the order, given that our company cannot know the data required for invoicing if they are not provided (ID number, registration number, etc.).

These sales terms and conditions will form the basis of the contract thus concluded.

OBJECT OF THE CONTRACT

The subject matter of the contract is the goods in respect of which the customer has expressed his choice to purchase them, by generating an order on www.jelli.eu, confirmed by our sales staff.

PRICE OF THE CONTRACT

The price of the products is the one mentioned on www.jelli.eu. It may be amended at any time without prior notice to its stakeholders. The exception shall only make orders which have already been confirmed. Changes in prices did not apply retroactively.

If the buyer cannot be contacted using the contact details they have provided during the order process, within a reasonable period of 3 working days, jellí will deem the order as cancelled and the buyer will be notified of this by email or SMS.

jellí makes every effort to ensure that the prices are correct. However, errors may also be made. If an error relating to the price of products already ordered by the buyer is discovered, the buyer shall be informed of the error as soon as possible. In these situations, the customer will have the option either to reconfirm the order to the correct price or to cancel the order.

If the buyer decides to cancel the Order, after having been informed of the correct prices of the goods, but before that time they have already paid their price, jellí will offer reimbursement of the dispute as soon as possible, but without exceeding 10 working days from the date of cancellation.

To the extent that jellí has not informed the buyer of the erroneous prices, in accordance with the provisions of the present section and has confirmed the order, the valid contract concluded will be properly executed and the products will be delivered in accordance with the SHIPPING POLICY section below. The quoted prices DO NOT include VAT as well as any other tax (duties or other tax imposed by the country laws the buyer sets the delivery address in), but do not include delivery costs. The advertisements and offers present in our online shop are valid within the limits of the available stock and are not cumulative with other promotions/special discount programmes, unless specified otherwise by jellí authorised representatives. Please be wary of misinformation and do your due diligence to ask us via phone or email.

International delivery orders must be paid in advance!

The invoice is issued automatically, exclusively by email, on the day on which the parcel was handed over to the courier company or on the day of delivery. The customer is fully responsible for providing an incorrect, incomplete or invalid email address. The customer can ask jellí to resend the invoice by sending us an email at shop@jelli.eu.

  1. PAYMENT

The price, the method of payment and the payment deadline are specified in each order. jellí will issue the customer an invoice for the products to be delivered. The customer’s obligation is to provide all the information needed to issue the invoice in accordance with the legislation in force.

Payments are made only in national currency, or at the BNR exchange rate for the European EEA + EFTA- leu/lei and euro countries and by paying online by bank card.

  • Online payment by bank card – it is done by Stripe. Stripe is a processor of online payments, and this payment method is intended for all holders of cards issued under the Visa, Mastercard or Maestro logo of any currency.
    For the purposes of payment, you will enter your card number, expiry date and code CVV2/CVC2 (the last three digits on the back of the lane, which also cover your signature). Cards issued in other currencies are also accepted. The payment will take place in RON, following the conversion of the currency at the Visa/Mastercard rate and the exchange rate of the issuing bank. When cancelling an order paid online by bank card, the payment is automatically sent to the payment processor by email and the money will be returned to your account. As a rule, this process will take about 14 calendar days. It may take up to 45 days according to the conditions of the bank issuing the card. No additional fees are charged for transactions. jellí does not request or store any details of your card.
  • Bank transfer: Payment by bank transfer is made only on the basis of an order placed on the website, and the amount will be paid using the bank account data provided on jellí website at the end of the order. When the amount is registered in our bank account, the order is prepared and the order is made to the courier to collect it. We would point out that this payment method may delay the processing of the order up to 5 working days during the approval of the transaction by the bank. We do not process orders that have missing bank transfer details that do not fall within our specified guidelines.

For payment ‘online with the Banking Card’, by ‘Bank transfer’, the order is sent only after the payment has been confirmed.

  1. PRIVACY POLICY

The confidentiality of the personal information of jellí clients is one of the aspects that we have dealt with most seriously.

jellí collects information via the website www.jelli.eu, in accordance with the Romanian legislation referring to these issues and GDPR laws. The website places “cookies” on the visitor’s computer, which are used for authentication, adding products in carts, placing orders and collecting statistical information on the use of our site.

The collection of data shall take place through:

  • The client registration form;
  • The customer information update form;
  • The form for placing orders;
  • Contact form;
  • The produced review form;
  • Newsletter subscription form;

The personal data collected via the website is used to facilitate direct and indirect communication with customers, invoicing of products ordered by you and informing users of:

  • status of orders placed
  • delivery of orders
  • the availability of one or more products in stock,
  • available offers/promotions
  • account statement on the online platform jellí
  • evolution and status of orders
  • evaluation of the products offered.

In accordance with the provisions of Law No 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended, jellí isi assumes the obligation to administer under safe conditions and solely for the specified purposes, the personal data provided by the users of our site.

Our company undertakes not to transmit the data collected to third parties, with the exception of courier companies in order to deliver the products and the statements expressly provided for by the Romanian legislation in force. Thus, your personal information may be provided to the Public Prosecutor’s Office, the Police, the Courts of Justice or other competent State bodies, on the basis and within the limits of the legal provisions and following specific requests made.

Any user who has explicitly provided personal data on jellí website may choose to remove it from our database by sending an email to shop@jelli.eu stating this request.

If users do not wish to receive commercial communications by email from our company, they can use the unsubscribe link from the footer of jellí newsletter received by email or communicated by email to the addresses provided.

In the event of a dispute, an amicable settlement will be sought within 30 working days from the registration of the complaint at the headquarters of jellí. If an understanding is not reached after the expiry of this period, the dispute shall be settled by the Arbitration Committee attached to the Bucharest Chamber of Commerce and Industry or by the competent courts of the Municipality of Bucharest or by the appropriate European authority.

  1. PRODUCT CARE

Please comply with the information given on the label of each individual product. In order to prevent situations where the product may alter its odour, colour or composition, you should stop using it altogether. The products were recommended to be hermetically sealed immediately after use. In addition, cosmetic products must be stored in places with a constant temperature, free from direct sunlight or excess moisture. If you have not complied with these indications and the product has a suspicious smell or colour, we recommend that you no longer use it and remove it altogether.
